Joley Law Firm PC was established by Dave Joley, Chief Counsel.  Mr. Joley is a Fort Wayne native, graduating from Bishop Dwenger High School in 1996. He is admitted to practice law in front of the United States’ Supreme Court, the Federal Districts of Northern and Southern Indiana, as well as the State of Indiana. His practice areas include family law, administrative hearings, and jury trials with a concentration in Criminal Defense, with a specific focus in drivers license issues.

 

Mr. Joley is a member of the National College for DUI Defense, the National Association of Criminal Defense Lawyers, NORML, past member of Indiana Trial Lawyers Association, American Inns of Court, Benjamin Harrison Chapter, as well as a member of the American, Indiana, and Allen County Bar Associations. He obtained a Bachelor of Arts degree from Indiana University in Bloomington, Indiana, and graduated from the University of Dayton, School of Law.

 

He is qualified in the Standardized Field Sobriety Tests, has attended the National Forensic College in New York, and has completed the trial advocacy training at the Trial Practice Institute sponsored by the Indiana Public Defender Council. Dave is also a two-time attendee at the Summer Session for the National College of DUI Defense in Cambridge Massachusetts.

The United States Constitution, as well as the Indiana Constitution, protects THE PEOPLE from unreasonable search and seizure. That means all the people, including you. If you are charged with a crime in Indiana, you would have the right to a public and speedy trial. The trial could be either a jury trial or a trial by the judge sitting without a jury (a bench trial). You have the right to a jury trial. However, you may waive a jury trial.

 

If the trial is a jury trial, the jury would be composed of either six or twelve people from the community selected at random to decide whether the government has proved your guilt beyond a reasonable doubt. As your attorney, both you and I would have a say in who the jurors would be, by removing prospective jurors for cause where actual bias or other disqualification can be shown, or without cause by exercising what is called peremptory challenges. The jury must agree unanimously before it could return a verdict of either guilty or not guilty, and if they cannot reach a verdict after deliberation, then the matter would be considered a hung jury. If the trial is held by the judge without a jury, the judge would find the facts and determine, after hearing all the evidence, and considering each charge separately, whether or not the government proved its case beyond a reasonable doubt. And Joley Law Firm will be there to help you fight.

 

At a trial whether by a jury or a judge, the government must present its witnesses and other evidence against you. You, with the Joley Law Firm at your side, would be able to confront those government witnesses by cross-examination. You then have a right to present witnesses of your own and any other evidence on my own behalf, with the help of the Joley Law Firm. If the witnesses for me would not appear voluntarily, Joley Law Firm would assist in getting your witnesses to appear for trial, with the assistance of the Court, through the subpoena power of the Court.
